This privacy policy provides information about the processing of your personal data (hereinafter also referred to as “Data”) by RWG MARECO LLC (hereinafter also referred to as “MARECO,” “Data Controller,” “us,” or “we”).

The Data will only be processed to the extent necessary for processing your application and for correspondence with you. The Data collected is used exclusively for the purpose of processing your request. Your Data will be processed in compliance with Appicable Data Protection Law.
3.5.Use for the Conclusion of a Contract or Other Agreements
If you conclude a contract or other agreements with us, only the Data you have provided or that has been passed on by third parties with your consent will be used. The conclusion and execution of a contract or other agreements would not be possible without the processing of your Data. If the use of special types of personal Data is necessary, this Data will only be collected and used if and to the extent that you have consented to this. We obtain your consent in accordance with applicable data protection law.
If we compile statistics using the data categories specified in Art. 9 (2) (a) GDPR, this will only be done for the purposes specified in Art. 31 (2) (e) DSG and Art. 9 (2) (j) GDPR. Failure to give consent for a particular category of Data may result in the service contract or other contract not being concluded or being terminated.

To fulfill the aforementioned purposes, we also transfer your Data to third parties (e.g., IT service providers as “Data Processors”) with your written consent in accordance with applicable data protection law. The categories of these recipients are divided as follows:

We use external service providers in the EU and/or Switzerland to fulfill our contractual and legal obligations. These service providers may also receive Data for these purposes if they maintain confidentiality and comply with our data protection instructions.

For some of these third countries, there is a positive adequacy assessment or decision in accordance with Art. 16(1) DSG and Art. 45(3) GDPR. The same applies with regard to appropriate safeguards within the meaning of Art. 16(2) DSG and Art. 46 GDPR. 6.3.Other Recipients
In addition, we may transfer your personal Data to other recipients, such as authorities, in order to comply with legal disclosure requirements (e.g., law enforcement agencies or social welfare authorities).
7. Where and for how long is your data stored?
The Data is stored on a Swiss cloud solution from Microsoft in Switzerland. Tresorit Ltd. regularly backs up its server. In addition, we and Tresorit Ltd. restrict access to the personal data concerned through organizational and security measures.
If the data is no longer required for the aforementioned purposes, it will be deleted after the expiry of the statutory retention period and blocked for further processing for the remaining duration of the statutory retention period in accordance with the applicable data protection law.
Your data will generally be processed for as long as required for our processing purposes, the statutory retention periods, and our legitimate interests for documentation and evidence purposes.
8. The security of your personal data in accordance with the principle of privacy by default and by design
MARECO will take appropriate technical and organizational measures (in particular pseudonymization of Data, data minimization, and restriction of access to the Data concerned to persons who process this Data for the purposes of data processing) both at the time of determining the means of processing and at the time of processing itself, which serve to effectively implement data protection principles and integrate the necessary safeguards into the processing in order to meet the requirements of applicable data protection law and protect your rights.
This obligation relates to the type and amount of your Data that we collect, the extent of its processing, and the duration of its storage and accessibility. These measures ensure that your Data is not made accessible to an indefinite number of third parties without your intervention.
In the event of a breach of personal Data protection, MARECO will notify the competent supervisory authority (Federal Data Protection and Information Commissioner (FDPIC)) immediately in accordance with applicable data protection law after becoming aware of the breach, unless it is unlikely that this breach poses a risk to your rights and freedoms. If the breach is likely to result in a high risk to your rights and freedoms, MARECO will notify you of this breach without delay, if possible, in accordance with applicable data protection law.
9. What are your rights?
In order to show you all the options available to you regarding the collection and use of your information and Data, we would like to draw your attention to your rights in this regard, based on the applicable data protection law.

9.1.Right to Information
You can request information about how, by whom, for what purposes, and under what conditions your Data is collected and used.
9.2.Right to Correction
Of course, we do not want to pass on incorrect or outdated information when using your personal information, in order to prevent misunderstandings or possible damage, for example. Therefore, you have the option of updating or correcting the information we have collected about you at any time.
9.3.Right to Restriction of Processing
You can also request that we restrict the use of your Data. This means that your Data will still be stored, but may only be used under limited conditions (e.g., to assert legal claims).
9.4.Right to Object
If we collect and use your information and Data on the basis of legitimate interests, you naturally have the right to object to the use of your information.
9.5.Right to Erasure
Last but not least, we also delete your Data if it is no longer required for the purposes stated here and if we are not subject to any retention obligations. However, if you believe that there is no legal reason for further storage, you can assert your right to have your Data deleted. We are legally required to delete the Data within 30 days.
9.6.Right to Data Portability
You also have the right to data portability with regard to all Data that you have provided to us. This means that we will provide you with this Data in a structured, commonly used, and machine-readable format.
10. Consent and withdrawal of consent
